The Latest on David Otunga and Jennifer Hudson's Custody Battle

David Otunga is back in business with his son because he's now the primary custodial parent... TMZ has learned

David has been the primary caregiver to their son since his birth due to Jennifer's travel schedule.

In an update, TMZ reports that Otunga now has primary custody of their son.

Hudson, a former third-season American Idol finalist, and Otunga - who competed on VH1's I Love New York 2 and finished as its second runner-up - began dating in 2008, and Otunga reportedly proposed marriage only a few months into their relationship. This temporary custody agreement has come about as JHud is busy filming The Voice UK in London AND has to travel to Los Angeles quite a bit for commitments for the US version of the singing competition. He and David Jr. will presumably stay in the area. Otunga denied the allegations, and his attorney, Tracy Rizzo, accused Hudson of filing the "meritless" petition for the order of protection as leverage during the custody battle.

Although the protective order is no longer valid, Otunga says he has no plans to move back into their previous family home in Chicago.

The two parties have since apparently chosen to try and make the split as amicable as possible for their only child, with Jennifer giving David permission to spend Thanksgiving holiday (23Nov17) with their boy last week.
